TAX RESOLUTION

A tax resolution program is a service that represents the customer in the resolution of past due IRS and or state tax liabilities in order to give the customer a tax-debt free life. The tax resolution process involves negotiation and implementation of approved IRS or state tax programs designed to assist both the taxpayer and taxing authority in the collection of past due tax liabilities.

Of course a taxpayer can negotiate with the IRS or state on their own; however, professional representation provides numerous benefits to the customer that may not be achieved on their own. Taxpayers who enroll in a tax resolution program are immediately represented by tax attorneys as soon as the power of attorney is filed with the IRS or state taxing authority. The attorneys handle all communications on behalf of the customer, thereby relieving them of the stress and anxiety of dealing with the IRS or State. After filing the POA, the attorneys begin to collect all information the IRS has on file and perform an in-depth analysis of the customer’s current and future financial situation. This analysis is then applied to the IRS collection procedures in order to qualify the customer for one of the approved IRS collections programs available.

The analysis is designed to maximize a taxpayer’s allowable monthly expenses and reduce their monthly income so that they can be placed in a resolution program that allows them to avoid enforced collection activities such as levies, garnishments, or seizure of property, and to set up a formal and permanent resolution of their tax liabilities. Depending on the taxpayer’s financial situation, they may qualify for: a settlement, in which they pay far less than what they owe as quickly as possible in exchange for the discharge of the total liability; a monthly installment plan which may or may not pay the back taxes in full; a hardship status in which they pay the IRS nothing; or the abatement of penalties; among others.

Once the agreement is approved with the IRS, and the customer remains compliant with all future tax filings and tax payments due, the customer should be in a position to pay off their past due tax liabilities, and/or avoid enforced collections until their debt is legally unenforceable through the expiration of the statue of limitations. The tax resolution program should achieve two major goals for all customers: 1) provide short-term relief to the taxpayer by eliminating the fear and stress associated with dealing with the IRS one-on-one and 2) establish a permanent resolution plan in which the customer avoids enforced collections activity and resolves their past due tax liabilities.
